Did Jason Espy Conspire With Judge Connelly, & Intentionally Misquote Facts?

In its usual cheerleading and Assistant Counsel role to Bobby Lee Cook, the Summerville News embarrassed itself with its “Discovery” in today’s weekly edition.
Touting “Serious Problems” in news teasers this week, and then heralding a front page headline that this week’s re-indictment of Carlton Vines may be “Flawed”, reporter Jason Espy identifies two “serious” problems.
1) Instead of the words “True Bill” on the indictment, the words “Bill True” are used. This is actually how many areas of the state and country word indictments, and any one familiar with legal practices outside of Chattooga County would know this.
2) Even more ridiculous, and a screaming indictment against the Summerville News reporting, is that they pat themselves on the back for discovering what they place under the heading “Factual Error”.
What they claim is a factual error, however, is the very common use of indictment vernacular for indictments charging conspiracy.
“Carlton Vines did between the dates of June 26, 2006 and November 7, 2007…
I read indictments all the time, and whether federal or local, time ranges are very frequently, and in fact more often used than a specific date. Specific dates are rarely listed in indictments where conspiracies are charged, even when an overt act can be pinned down to a specific date, because in a conspiracy, there is planning before the actually commission of the crime, and cover up afterwards, all which play into the “Conspiracy” charge.
It is pathetic, and would seem to, in our opinion, point ever stronger to the need for the GBI and FBI to consider including the Summerville News in its RICO Indictments, as partners and facilitators in a Continuing Criminal Enterprise, CCE, along with their obvious conspiracy on at least two occasions to help subvert the free press by intimidating me, misquoting me and aiding and abetting Bobby Lee Cook, et al in their intimidation of and suppression of 1st Amendment Rights.
And, as would be common practice, the wording of such an indictment would be something along the lines of “On or about the dates of January 1994 and continuing through November 27, 2008, the Summerville News did conspire with Bobby Lee Cook to….”

Tuesday Evening, October 7, 2008 - Intimate Friend of Branch Connelly Speaks Out
The following “Comments” were posted yesterday and today, to an old thread - the very first set of articles in my almost year long Dixie Mafia Series, which I began, last year on November 4, 2007.
I have deleted her actual e-mail address and I.P., so that her identity can remain anonymous for the time being.
However, all of this has been passed on to Law Enforcement, per “Linda’s” request. Also, with her permission, I am posting this to the recent article about Judge Kristina Cook Connelly’s classless outburst and, lies and accusation at the September 5, 2008 Grand Jury, detailed below:

I was a close friend of Branch’s and know all about the fight with he and Kris…I also know many other “family” secrets I am sure they would not want aired. I have made contact with the GBI and the FBI in regards to Branch’s death. I am also the 603-252-0000 phone number in Branch’s cell phone log. You would find the same number if you checked Mr. Cook’s home phone log, Branch’s office log, Branch’s house log…etc. Even though it is evident that Branch spoke with me several times a day for years, no one ever wanted to hear what I had to say in regards to this case. It is deeper and darker than anyone would care to admit or know. A good man is dead and the evil goes on. As an outsider (not a Georgian) I certainly have NO fear of Bobby Lee Cook, his family, his friends, his “Dixie Mafia”, his daughter or anyone else his influence touches. I do know that Branch loved this man very much, he considered him a second father and his respect for Bobby Lee was deep and real. I also know he loved his children more than anything on earth. My public silence, thus far, has been fueled by the desire to protect his children more than anything else. I do, however, believe that Branch deserves more than he has been afforded. I think it is important that the truth, good, bad or indifferent be brought to light. As we approach the two year anniversary of Branch’s death, perhaps it is time to expose the truth. I am happy to share the information I have with those investigating the case.

I would say that YOU are the brave one. There is nothing the Cooks can do to me. I am far beyond their reach. Having read your breaking news story regarding Kris I can tell you that it is a public affirmation of the very private hell she put Branch through for years. As for poor taste, you have not even begun to scratch the tip of the iceberg. How a sitting judge can participate in the activities that I KNOW Kris to partcipate in , is beyond my comprehension. Of course, we do things a bit differently in the north.
Branch was always delighted to remind me that I was a Yankee. I am, indeed that.
We all have secrets. I would suggest to you that Kris’s are darker than most. I cannot say I would want her to sit in judgement of me. I do not think she should be sitting in judgement of anyone.
I am happy to have you pass along my information to the FBI, GBI or any other organization doing an investigation. (they should have it) I don’t want to be a part of the rumor mill but I would like to be an instrument in bringing the truth, about Branch’s death, to light.
You must be an amazing person. Thank you for giving a voice to those who are not able to find their own.

Monday Evening, October 6, 2008 - Joe Burford Is In The House!
Former Chattooga County State Court Judge Carlton Vines was re-indicted this afternoon, by the Chattooga County Grand Jury.
Vines was originally indicted last month, on Friday, September 5, 2008, for 1) False Swearing, 2) Illegal Possession of Absentee Ballots, and 3) Conspiracy to Commit Election Fraud, in the 2006 General Election.
But on that Friday, although only 23 Grand Jurors voted on the True Bill, the names of all 26 were listed on the True Bill. Attorney Bobby Lee Cook tried to say this was a vote by more than the 23 required members. Under Georgia Law, if more than 23 members of the Grand Jury vote on an indictment, then it is void per O.C.G.A. 15-12-61.
While it was clear that only 23 members had indeed gone into the room to vote, and that only 23 members had indeed voted, Special Prosecutor Joe Burford of the Prosecuting Attorneys Council of Georgia wanted to avoid another Myrtis Evans scenario, Evans v. State, 217 Ga. App. 548, 458 SE2d 357 (1995).
Of course, if Bobby Lee Cook had not been so desperately needy of the press attention, calling one of the Chattanooga television stations and yammering on as he always does to the press, Joe Burford may not have been alerted the precariousness of the situation, which required quick action.
You see, in 1995, Myrtis Evans was indicted on multiple bank fraud charges, having been caught red handed as they say. But after indictment, a member of the grand jury informed everyone that he was a city councilman, forcing the indictment to be charged again, AFTER her arraignment and after Bobby Lee Cook filed a plea in abatement the next day, which the prosecutor agreed needed to be done, due to the technical snafu.
After a brief presentation, a second indictment was returned, and only afterwards, a Grand Juror just happened to mention that he had been a high ranking member of the local Democratic Party.
So then, the second indictment was quashed without any disagreement from the prosecutor.
On a third attempt, Evans was again indicted, and eventually tried, but at trial the issue of how many times an individual can be indicted for the same offenses was raised.
According to public record:
“The record reveals that the Chattooga County Grand Jury in the August Term of 1994 returned three “true bill” indictments against Evans, each charging her with the offense of which she was convicted when tried pursuant to the third indictment. On arraignment day, August 12, 1994, the trial court, sua sponte, informed all involved defendants and attorneys that a city councilman had served on the grand jury in violation of OCGA 15-12-60 (b) (1). As a result, the trial court issued an order calling the grand jury back into session. Evans, by counsel, filed a plea in abatement the next day.
On August 15, 1994, the grand jury returned the second indictment against Evans. However, as the grand jurors prepared to depart, the foreman of the grand jury asked to approach the bench. The foreman explained that he had held elective office in the preceding two years as a Democratic Committeeman. The trial court, again sua sponte, excused the foreman based upon an alleged violation of OCGA 15-12-60 (b) (1), and directed the grand jury to reconvene that afternoon. After doing so and electing a new foreman, the grand jury returned the third indictment against Evans.
At calendar call on August 18, 1994, the trial court orally granted Evans’ oral motion to quash the first and second indictments. The district attorney concurred therein. “MR.
COOK: We move to quash the two previous indictments that were returned by improperly constituted Grand Juries, that the Court can take judicial knowledge and cognizance of.
We move to quash the two prior indictments.
THE COURT: Would that not be done by operation of law?
MR. VAN PELT: I don’t know, Judge, I think it would be by operation of law.
THE COURT: But in any event, the Court would not allow two or three indictments against the same defendant for the same thing.
MR. COOK: They are improper indictments, the Court can rule they are improper. Can I take an oral order quashing the two prior indictments? MR. VAN PELT: I don’t have any problem with that, Judge.
THE COURT: Order is so entered. I know of no reason why the same motion would not apply to all of the other cases.
MR. COOK: As a friend of the Court, speaking in Amicus Curiae, I so move.
MR. VAN PELT: Yes sir, we intended to eventually nol pros or quash all of those, the first two sets.
THE COURT: Motion granted as to all of them.
That way there will be no question about it.
MR. COOK: That’s right.
THE COURT: Those prior indictments are now void, with no force and effect whatsoever.
MR. VAN PELT: Yes sir.
THE COURT: All prior indictments because the Grand Jury had a public official on it, unless it has been waived, those indictments are quashed.” At the call of the calendar on August 22, 1994, the court stated: “Myrtis Evans was, indeed, one of these defendants that the Court was ruling on[,] Mr. Van Pelt.” Van Pelt responded: “That’s fine, Judge.
Mrs. Evans did, in fact, challenge the first indictment. . . .”
In a motions hearing on August 22, 1994, the trial court refused to memorialize, in writing, its oral ruling quashing the first and second indictments, [1] stating: “But I stand on what I did, if I’ve made a mistake, a legal mistake, then I’ll abide by it. . . .” The trial court denied Evans’ plea in bar, which was based upon a violation of OCGA 17-7-53.1 where the first and second indictments had been quashed by the Court.
In Evans’ sole enumeration of error, she asserts that the trial court erred by denying her plea in bar. OCGA 17-7-53.1 provides “[i]f, upon the return of two ‘true bills’ of indictments or presentments by a grand jury on the same offense, charge, or allegation, the indictments or presentments are quashed for the second time, whether by [a] ruling on a motion, demurrer, special plea or exception, or other pleading of the defendant or by the court’s own motion, such actions shall be a bar to any future prosecution of such defendant for the offense, charge or allegation.” (Emphasis supplied.) OCGA 17-7-53.1 operates as a statutory bar to a prosecution on a third indictment for the same offense, where, as here, the trial court has quashed two prior indictments thereon. See Smith v. State, 198 Ga. App. 647, 648 (402 SE2d 738) (1991).

So, 1-2-3, Presto-Digito-Bob’s Your Uncle - Myrtis Evans went free.
At least for a short time. The feds later indicted and convicted her, but charged her for only ONE banking violation, even though she had committed 192 banking violations, mail fraud, as well as what is defined as RICO Conspiracy in a Continuing Criminal Enterprise.
She ended up serving only 33 months, not enough to scare her into flipping on the Dixie Mafia of Chattooga County.
HOWEVER, PACGa’s Joe Burford is not a local cartel member, and he is not quite as “incompetent” and “stupid” as Chattooga County Superior Court Kristina Cook Connelly would have the public believe…as if. (See story below).
Joe Burford knew that if Carlton Vines were allowed to be arraigned this morning, then when Burford sought another set of indictments, then that second set might indeed be his last bite at the apple.
Well, as luck would have it, because all four of the LMJC Superior Court Judges decided to recuse themselves from hearing the case, the newly appointed judge, Cherokee Circuit Judge G. Carey Nelson of Bartow County had to reschedule Carlton Vines’ arraignment hearing until October 17, 2008, as he had a prior conflict this morning - as luck would have it.
Under Georgia law, if a criminal defendant has not yet been arraigned on the first indictment, he can be re-indicted on the same charges, WITHOUT it counting as a second indictment.
Thank heavens Bobby Lee Cook was so desperate for the attention of the press back on Friday, September 5, 2008.
AND, thank heavens, Joe Burford is in the house!

Monday, October 6, 2008 - PACGA’s Joe Burford at Chattooga County GJ Again
Although Carlton Vines’ arraignment on Election Fraud and related charges was postponed from this morning to October 17, 2008, Joe Burford and other staff members from the Prosecuting Attorneys’ Council as well as GBI agents arrived at the Chattooga County courthouse this morning, presumable to make yet more presentations to the Chattooga County Grand Jury which has been convened this morning.
Sources confirmed they saw the entourage entering the courthouse shortly before 9:00 am this morning.
We will update throughout the day, if and when there are developments.

October 2, 2008 - Judge Connelly Embarrasses Herself and Chattooga County
Yesterday, I got a very bizarre call from Jason Espy of the Summerville News, in the middle of dealing with having just learned about the death of my mother-in-law.
In the midst the sorrow and mayhem, Espy asked first, if he could ask me a question, to which I referred him to my attorney, as we have filed an Application For Removal to Federal court earlier this week, in the Stephanie Dennis case against myself and the website. But Espy quickly told me it was not related to the court case, and that it was a personal, off the record question, which I agreed to try to answer.
FYI - anyone wanting to read the lengthy Federal filing, which includes some VERY interesting exhibits, can go to the PACER website for federal filings, sign up for an account, and generally, in about 24 hours, you will be assigned an access code and password. Then you can read to your hearts content, any Federal case, civil or criminal, in the whole United States.
But back to Espy’s question:
Jason Espy asked me if I had talked to either Rick Malone or Joe Burford SINCE the Chattooga Grand Jury’s indictment of Carlton Vines, or if I had e-mailed them SINCE the GJ, and if I had passed any information to them about the investigation.
A Very Queer question, indeed.
My answer was that I HAD NOT talked to either since the Grand Jury indictment, and that I did not think that I had e-mailed either one since the Grand Jury Indictment, and that I did not pass information to anyone but the feds or those involved with federal investigations as a general rule.
I did remind him that I had talked to Rick Malone twice last fall, surrounding the Carlton Vines re-arrest, interviewing Malone, and that I had been forwarded an e-mail from Malone’s office to someone. I also told Espy that I had talked to Burford once this past spring, briefly, after the Chattooga County Election Offices were raided.
But compare what I told Espy, to what he printed in the Thursday morning edition of his family’s newspaper, under the headline, “Judge Connelly Blasts Prosecutors Behavior”:
“The Blogger admitted to talking mainly with Malone last fall and Burford this spring. But she also indicated that she may have forwarded information to Burford through e-mails about Vines’ case”.
WHAT?
Absolutely NOT TRUE. I clearly said I had NOT forwarded information to Burford, and the specific question was specifically related to POST-Grand Jury Indictment time period, anyway.
I have spoken to Espy today, and he has said he will take a look at it, and may post a correction on their website.
But what is really at play here?
The basic story is about how Judge Kristina Cook Connelly, daughter of Bobby Lee Cook, (both of whom I have written articles with substantiating public documents, relative to their participation in what Federal Investigators call the “Dixie Mafia”, NOT my term), dressed down in a most CLASSLESS manner, Special Prosecutor Joe Burford of the Prosecuting Attorneys Council of Georgia. Joe Burford and others were assigned by GaPAC to present allegations of Misconduct and Voter Fraud to the Chattooga County Grand Jury, specifically against the Cook family friend and Dixie Mafia partner Carlton Vines, who has been removed from office for multiple DUI’s.
That particular day, the Chattooga County Grand Jury indeed did indict Vines for 1) False Swearing, 2) Illegal Possession of Absentee Ballots, and 3) Conspiracy to Commit Election Fraud.
But prior to PAC being allowed to present their case to the Grand Jury, Judge Kristina Cook Connelly pitched a hissy fit, on the record, dressing down Burford, and making false allegations against both Burford and his boss Rick Malone. In doing so, Judge Connelly inappropriately and unethically raised my name, violating the Judicial Cannon of Ethics, when in those false allegations she called me “the Biggest Liar in the State of Georgia”.
According to Espy, Judge Connolly called Burford and his colleagues into her chambers, and officially, WITH A TRANSCRIBER, chewed them out for quite a while. During the course of the tirade, Judge Connelly unprofessionally demeaned Burford and his boss and colleagues using words like “stupid” and “incompetent” and essentially accused he and his boss of conspiring with me.
Under a column heading of “Influence”, Espy quotes the official transcript:
“Now, another matter, Mr. Burford, you have made attempts apparently personally to influence this grand jury. You have communicated with Teresa Watson who is one of the biggest liars in the State of Georgia and your boss either lied to protect you about that communication or created a Chinese wall to protect you about it”, Judge Connelly said.
So, was Espy sent by the Cook Clan to attempt to illicit some salvo, yesterday, which they could defend Judge Connelly’s inappropriate outburst, accusations and LIES?
Perhaps, but if that was the case, Espy still had to INTENTIONALLY misquote and print as fact which I clearly said was NOT fact.
Perhaps, then, The Prosecuting Attorneys’ Council, as well as the GBI who has investigated this whole Carlton Vines Election Fraud debacle, should be interviewing Jason Espy to see if in fact the Cook’s conspired with him.
I hope he did not.
At any rate, my attorney has been advised, a copy of this article has been sent to him, and he will be contacting Joe Burford, Rick Malone and others ASAP. He will also be filing a Formal Complaint on my behalf, with the Judicial Qualifications Commission against Judge Connelly.

I am distressed, TW. The SN printing a story with non-facts? A judge calling people liars and stupid and incompetent? Accusations of a conspiracy against law-abiding public servants? We are feeling faint and are swooning. We must recline and give this much thought. We, I mean I, will not rest easy with such drama playing out. At least no one has been physically attacked at the courthouse lately. We must be thankful for that.

Hey, I called Jason Espy twice today, and the first time, I put him on notice that we would be subpoenaing him to testify at the Federal Hearing, so that Judge Murphy, who will have to decide if we can move the Stephanie Dennis case to Federal Court, can see what we have to deal with Lawyers and Judges who are under Bobby Lee Cook’s control.

The reasons are all listed on the Federal website, PACER, and they are all United States Code and FEDERAL, 11th Circuit Court of Appeals Case Law, one of which BLC cited in a Reply Brief last month, mistakenly saying that the courts had ruled supporting his argument. OOOOOOOPS. He forgot to fully research, and the 11th Circuit AFFIRMED the Florida court of Appeals AND EXPANDED.
But BLC’s citing that case opened the door for us to Remove to Federal Court. Go read the MOUNTAINS of NEW FEDERAL APPEALS Case Law in our favor. It’s all there David. Anyone can read it.
BTW, I can always gauge how deep the doo-doo is that one of ya’ll have stepped in, when the likes of Redneck, The Shadow and you appear to blog. The Princess Really Screwed herself this time, didn’t she, and the Summerville News helped!
Something lese I noted, in Jason Espy’s article, is how vicious and mean Judge Connelly is, how condescending, just like her father, calling names when reason and logic cannot help them. Sort of like Redneck, Shadow and you.

What I find interesting is that a judge in the LMJC and family member of blc who was also an attorney before she was a judge is calling someone a liar. Is that not the pot calling the kettle black? She must be as arrogant and perverse as her father. I wonder if she has a bust (Head) of herself in her house? I also wonder what kind of a moron would decide to hook up with her after the suspicious nature of her first husbands death and the corruption that surrounds her father and all his cronies. Of course, most of us around here know that Al Palmour and Kristina Cook grew up together being the posh children of the now infamous Cook and Palmour law firm. They should be comfortable in the same court, courtroom etc., this time as defendants. I got on a rant on the feature story post and forgot to mention my trip to CC today. I saw a copy of the SN on a counter and mentioned the front page story having something do to with that woman that has the website. Oh, did I get an ear full. I had to feign a shocked look just to keep from being so obvious. This woman went off on the SN big time. “Why don’t they leave that woman alone?” “Who do they think they are?” “Everybody knows they are a bunch of crooks.” “Do they think we are stupid?” I won’t repeat more because she was brutal. Apparently TW and her fight are the topic of the day. I need to make a weekly trip just to get a feel of what is really the local mindset. The SN is digging their own grave.

I was up that way last Friday, and had lunch in Trion. A sweet old gentleman look ed at me and asked if he knew me, and I was not from around there, but that I wrote articles on Public Corruption and was very familiar with Bobby Lee Cook and that gang.
A flash of recognition came over his face, and he told me, “I know who you are, your that one everyone is always talking about. Well, you have plenty to keep you busy up here”. We introduced ourselves by name as I was leaving, and while I will not share his name for fear he will be threatened, he told me what a pleasure it was to meet me, and to keep up the good work.
These sort of encounters are precious to me. Which reminds me. A friend suggested I post the addresses of Joe Burford, Rick Malone, Karen Handel and Shawn LaGrua on the website, so that folks can send them Thank you notes and cards for fighting to fight up here. I will do that this morning!

I can tell by your first question that you have either a) not read the PACER file or b) you do not understand what you read.
Either way, I have no time for your refusal to accept what Federal Jurisdiction after Federal Jurisdiction at the Appellate level has ruled and said.
It has always been a Federal Issue. But my first attorney chose for whatever reasons not to remove, and the 30 day window of opportunity was closed. Then, because BLC recently cited a Federal Case trying to prove his point, screwing up the logic completely, wrongly alleging that the lower court had ruled in what he is trying to say is his Plaintiff’s argument’s favor, ALTHOUGH THEY DID NOT, and then missing entirely the final 11th Circuit Court of Appeals ruling which held for the lower court’s decision WHICH IS OUR DEFENSE, the window was opened for a lawyer who actually really does research case law and really does know what he is talking about.
On top of all of that, Bobby Lee Cook even chastised my attorney, in the Pleading, for not citing any 11th Circuit Court of Appeals case law to support our DEFENSE, and yet what he had cited was the 11th circuit Court’s case law, just one of many, which supports my defense.
That is why, although a case has only the first 30 days to Remove to federal court, it can be reopened again, as case after case after case after case….at the Federal Appellate level has agreed, because the Plaintiff’ foolishly opened the window AGAIN.
It would not be so pathetic if the case he had cited had been in his client’s, the Plaintiff, favor, and then we would have to argue against it. But the cases, plural, which he cited, ALL hold for our very defense. So, Bobby Lee Cook not only opened the window to allow us another 30 days to Remove to Federal Court, he ALSO gave us more ammunition with which to defend our case, which is already completely undergirded and supported in the Federal Law itself…47USC230.
We are almost at the point where we think that there is someone in BLC’s office ACTUALLY WORKING FOR US, clandestinely. How else, other wise, could they have been so careless?
They had my former attorney in their pocket, and thought all was lost for me. But they overplayed their hand, thinking I had no financial options, which was true. BUT THANK GOD there are actually brilliant research attorneys out there whose concern is less about the money, and ALL ABOUT THE JUSTICE - finding one whose undergraduate is in Philosophy and whose Masters Degrees and first Ph. D are both in Divinity from Yale, then you may have found the right guy.
Vincent Anderson of Dalton is just that sort of man, as Ben Ballenger has always been.
If you still do not understand why we get to go into Federal Court now, think of it on a Perry Mason sort of level - or better yet - MATLOCK, LOL! We have all seen those shows, where there is a peace of crucial evidence which the Judge has barred the prosecution from referring to or entering in as part of the case. But the minute a witness refers to the evidence or scenario the judge had said was taboo for the other side, then - Katie bar the door - once the Cat is out of the bag from a mistake by the side who did not want the Cat out of the bag, then the other side gets to use it! It’s all fair game then.
This is essentially what Bobby Lee Cook did, but in a Pleadings manner, not direct testimony as we see in television. In researching what BLC cited, we not only found supporting case law for our already strong suit, but we learned that in that very case, they had re-opened the Federal Issues as well, and as MOST FEDERAL APPELLATE CIRCUITS HAVE HELD, once the window was open, the Defendants could come in again.
So, Thank you Bobby Lee Cook and STAFF!
Now, I almost forgot to answer your second, what ever - your “oh, BTW” as I got carried away with the Federal Removal.
Okay, I am going to paint a picture with a HYPOTHETICAL Scenario:
Let’s say that a pesky, but truthful and public documents relying reporter happens to come across evidence and Several Witnesses to crimes involving Beelzebub Lucifer Satan. She publishes stories about the crimes, and a couple of the witnesses actually contact her and tell her they want to come in and give up what they know, as long as they are given protection. They share their information with the intrepid girl reporter, and it is very damning indeed, not only to BLC and his family and his other associates, but to these key witnesses as well.. They are coming in of their own accord, admitting to crimes they have participated in, and KNOW they too will have to serve Federal Time. They are EXTREMELY Credible to any court, because that is called a Witness Against Best Interest.
But they are sick and tired and scared and they have seen the writing on the wall.
So, Intrepid Girl Reporter contacts some Feds she knows are working on a case which will bring down BLC and his Associates, and she hooks up the witnesses with the feds, and they go to testify at the Federal Grand Jury.
Now, along the way, she has been hearing rumors that there are ALREADY Federal Indictments…rumors from federal agents themselves.
As a show of support for the witnesses she has brought to the feds, for their trust in her accuracy in the stories she has covered so far, including ones involving them, our intrepid girl reporter travels to Atlanta where they will be testifying to the Federal Grand Jury. Let’s say she is not even allowed to go the floor where the Grand Jury is impaneled, so she finds a place to park her rather large and expanding backside, and waits. The several witnesses come and go, and are tearful, but resolved, as they have already been debriefed and their Plea Deals have already been worked out before they come to testify at Federal Grand Jury.
They leave, and she still waits, until awhile later, a federal agent who is working the large case, comes by in the little lobby where she is waiting, grinning from ear to ear and gives her the thumbs up.
Let’s say that is late May. But she also learns later that this testimony which she helped secure, has had to be ADDED to an already existing indictment, as a SUPERSEDING indictment.
So, given the date that she got the thumbs-up about a True Bill being returned, she has counted forward 180 Days, which is the Maximum time a Federal Indictment, once issued, can remain sealed. That would place the 180th day on or about November 24, 2008 - the week of Thanksgiving.
But given that the indictment she knows about, became part of one already Sealed, then she knows that November 24, 2008 is actually LATER than the indictments can be unsealed. As she pesters federal agents and prosecutors to learn When?-When?-When?, NO ONE will say a word except that she has been told that it should be a Very Happy Halloween - but if not, definitely a Very Happy Thanksgiving.
Now end of the Hypothetical Scenario.
If you have indeed read the PACER cases, you will find that an Affidavit sworn to by me, is attached as part of one of the Exhibits in each case. IN that Affidavit, you will find that I admit that I have played a part in getting Witnesses to the Federal Grand Jury, and that I have been assured that Indictments are to be unsealed Imminently. Do you really think that I would have risked LYING in an Affidavit, if that were not true and provable? ESPECIALLY if the Affidavits are to be filed in a REMOVAL to Federal Court, where all of those federal agents can see what I have sworn to?

What is really interesting is the Summerville News thinks the public believes all their bogus stories. I have spoken to people in this whole area of the LMJC and they all have one thing in common. They all believe the system is so corrupt and they cannot believe these attorneys and judges have gotten away with thier corruption for so long. These people have another thing in common, and that is the members of this corrupt judicial system have a history of using the judicial system to retaliate against those that hold them accountable for their corruption. Therefore they have created a level of fear amongst the citizens of the four counties, Chattooga, Walker, Catoosa and Dade Counties, that encompass the illegitimate LMJC.

How is it that in the Evans case, twice, public officials in the Democratic Party were on the GJ? I have said her publically for the last year that I felt Branch was murdered. I only hope that it is proven and all those involved are charged accordingly. There is no way in the world that he would bother going to the dentist, just before killing himself. His wife, in my opinion, had him killed so she could be with her new man. The Cook family was fearful of what knowledge he possessed that could hurt them and their fellow cohorts in crime. So he was disposed of accordingly…and they set it up to look like a suicide. Unfortunately, Ralph “back to the used car lot” Kellett, never had any formal training in law enforcement or crime scenes…and thus never followed normal law enforcement protocol. Not that I would expect him to know how to anyway….having zero criminal justice background. Plus he was so far up Bobby Lee’s a$$, that it would have been perceived as an insult, I’m sure. Have no fear because the FED’s are hot on the trail. Everyone, and their mothers, have lined up to give them actual accounts and plenty of evidence to build a rock solid case. As this goes on I get sicker and sicker. The night Branch died he called me to tell me that Kris was leaving. He told me that she had even packed her jewelry. ( This was how he judged that she was really leaving) He also told me that her “lover” a doctor was coming to get her. His exact words were, ” this crazy fucker is fixin’ to come to my house, Linda” I was incredulous at the time, knowing Branch, I could not imagine another man coming to his home under these circumstances. I passed this information along to the GBI at the time of Branch’s death and suggested that they might want to find out who the DOCTOR was. Wouldn’t that be the perfect person to stage a fake suicide???? Now I read that Kris is engaged to a doctor?? True or not, it would be interesting to find out where this doctor was the night of Branch’s death. I have long suspected that the reason Kris heard no gunshot was because she was not only not alseep in another room but not in the house at all. If what Branch said was true (and he had no reason to lie to me) she was leaving with the doctor that very night. I find myself getting furious over the antics of this family and the authorities responsible for investigating the FACTS of this case.
My heart goes out to his children. I wish, beyond all else, that he were here to protect them from all this. He loved those kids so much. He loved them enough to stay in circumstances that most would not survive.
As far as Kris goes…..I know all the secrets. All of them. It has never been my wish to make public the seediness of it all and I will not EXCEPT where it pertains directly to the case of Branch’s death.

Branch did not tell me the doctors name. As I told the GBI though, how difficult could it possibly be to find out who he was. They were at the point of him coming to the house so it was not a casual affair. While I realize that Kris’s activities were well hidden, I cannot believe that there is not someone who knows. According to the SN website there are more “possible” problems with the second indictments of Carlton Vines. More to follow in the paper edition today. Is there no justice in the judicial system? It also says that Judge Connelly is facing administrative hearings in regards to her antics but suggests the problems with the grand jury might have a bearing on that, too.

The SN is claiming that the second indictment of Vines is flawed also. According to Gene Espy “Our staff has discovered grave mistakes in the Prosecuting Attorney Council’s (PAC) indictment against Judge Vines”,”Simply put , the prosecutions’ allegations as stated in the indictment appear to be on face in error”. He goes on to qualify that by saying that the time line is incorrect,that the ballots were not received by Jon Payne’s office till Sept. 25. The indictment says that Vines had the ballots in his possession between June 26 and November 7. My thoughts are that September 25 does fall between June 26 and November 7. Or at least it used to , but maybe BLC got that changed too. Can we get away with lynching anymore? The other flaw is a minor wording flaw instead of true bill it reads bill true. Again they may have jumped too soon because Vines has yet to be arraigned.
It is clear from all of this that the judicial system in Chattooga county is a game rather than a court of law and the SN is a player.

Branch called me from the guest room at Bobby Lee’s house earlier in the evening. It was then that he told me about the doctor, Kris’s antics and many other things. He called me later in the night, at some point (not certain of the times) and then he called and woke me….seeing the call log here for the first time I realized it was 3ish. I didn’t know what time it was before seeing that and cannot swear that it was or wasn’t. I was sleeping. I told the GBI what he said to me when he called, as I think it was important.
As it was normal for me to speak with Branch several times a day I have no way of knowing exactly how many times we spoke that particular day or night.
The great sadness of my life was that it took me a week to find out that Branch had died. The person he told me would contact me if anything happened to him , did not. While I could not believe that he had not called me, I thought that perhaps he and Kris were trying to work on things ( how wrong I was) I left many messages for him but it was when his phone was disconnected that I knew something was terribly wrong. I knew he would never disconnect his phone without telling me. (by the way, disconnected on the day he was buried) *I often reflected on this. I wondered if it was my constant phone calls that necessitated the shutting off of his phone. Still, I could not help but think, “if that were my husbands phone and he had died in such a tragic way, would I not answer it and tell ANYONE on the other end.” It is obvious that I was a close friend. It was obvioius that I was worrried sick over him. I found out by calling his secretary on Monday morning, one week after he was found. I cannot even describe to you the heartache. Going back over that night, over and over and over. Trying to remember every little detail. Trying to deal with his death and the mourning of him from a distance. It is all so very heartbreaking.
My only concern, at this point, is that the truth, THE TRUTH, there is only one truth and I want it to come out, finally.
As I said before, my heart goes out to the kids. I would protect them if I could BUT I don’t think allowing them to think that their father just went home and killed himself is doing them any favors. And I know the explanation of he and Kris going home and watching tv was a down right lie.

I have had a HUGE breaking element of the bigger picture breaking about the same time as when you contacted this website the other night.
I have been working on that and have not had a chance to respond, or to even write the rest of the Feature Story for yesterday, as I have had to take a little ride to check something out about this new element brewing. The leads are coming in so fast right now, I literally cannot keep up with them these last six weeks or so.
But I wanted to let you know that you are right about Kris NOT BEING there. Part of the GBI report indicated that even the Husband & Wife next door KNEW her car was not there all night.
So much is fixing to break, (I mean weeks/less than 2 months), and I am so grateful that you have chosen this website to come out on.
You are also right about Kris’ tirade spewed forth at a Joe Burford, a Public Servant executing his job and following the leads where they tale him, and following the law and proper protocol, which she would not recognize if it bit her in the a$$, is only a taste of what Branch lived with, judging from what other close friends here in Rome have told me.
Thank you again for not letting Branch’s death be forgotten. Of all the brutal things Bobby Lee Cook and that cartel have done, including his brutal attacks on me, my website, my business and my reputation, the murders and the child exploitation are the worst.

I am sure that info about Kris, and Branch’s family is easily researched. I hope people leave his children out of it. They are grown adults but that does not make any of this any easier on them. Last I knew, Branch’s father was still living. I believe Branch has two sisters, also still living as far as I know. I don’t know if Branch’s ex wife is still living or not. There were no children from that marriage.

I did post to a site right after Branch’s death. I don’t recall what it was exactly but I am sure it could be tracked down. I really believed that no one down there cared and I didn’t know where to turn until I was linked with your site (by a close friend of mine who kept up on the research) I am so thankfull for you and your diligence expecially in the face of all you endure. What is wrong with these people? Do they truly believe that this level of corruption is okay?? Please bare in mind I have know intention of bringing the children into the wicked web that blc and kc has woven for themselves. I did not even know there were children and knowing this makes their actions more dispicable. I know nothing about any of the cooks other than they are people of questionable character and what I have learned on the internet and through conversations with people in that area. I would never do anything to jepordize the integrity of the innocent. I am curious about the personal aspects of this tangled web of corruption not to cause harm to the innocent but just to be more familiar with what is going on. I do not want to know anyones name, occupation, location, etc., just a little background information for curiositys sake, nothing more. I understand why we should not post this information on this website as it could be miscontrued and actually get the innocent involved.

Have you spoken to this person since you got the news about Branchs’ death, to find out why he did not contact you and let you know what happened? I agree about his children, Keep them out of this. It was someone from his office. It is someone I met while with Branch and it is someone who told me “no one will ever know we have met” I don’t want to go further than that. It was very clear to me, VERY clear, that his loyalty was to the family and NOT to Branch as I had previously thought. With that realization I did not give him ANY of the information that I had as I was going to do and was my intent to do. It is even more clear to me now, having found this site, that my intuition was dead on. I am happy that I didn’t give anything to him and instead choose to call the GBI, FBI and another friend Branch told me to call in case something happened to him.

Last year, almost immediately after I began this series, some folks in the Marietta area, with ties to Lookout Mountain, told me that she was dating a Tennessee cardiologist, and had been at many holiday parties with him, (2007).
That is all I know.

I read that in a previous post here. Can anyone confirm it? As I said before, someone should find out where the good doctor was on the night of Branch’s death. Was he the “crazy fucker fixin’ to come to my house” (Branch’s words) I would also like to know where Branch’s dogs were that night. He loved those dogs like children….and they loved him. So, where were they?? My dog would go crazy if someone came into my house and confronted me. He would also be severely distressed if anything happened to me. I know he would not give up barking and whining if he thought I was hurt. I have to believe that Dexter would be equally upset if something happened to Branch…..not sure about the other one…the little girl dog (cannot think of her name) ….Branch always said she was so sweet…..she may have been too timid to be confrontational. Did the neighbors hear the dogs barking?

The story about Branch comes almost entirely from the original GBI report, including only a couple of interviews.
But, MURDER has no Statute of Limitation, and anyone can re-open the case, like a new Sheriff or the GBI or the FBI.

What can I do? Isn’t there anyone who cares about this man enough to press this issue directly with the GBI ? Being so far away makes me feel helpless. You can be sure, if I lived there, I would be banging on doors until someone did something.
I am sure that Kris and the good doctor had NO idea that Branch was close enough to anyone to tell them what was going on that night. I am sure that she has NO clue what else he told me. If I were the doctor and NOT involved in this death, I would be running as fast as I could in the other direction. Of course, perhaps he is drawn to the very thing that repulses most of us. One never knows.

What I find interesting is by Branch using the phrase, “should anything happen to me” he suspects something will happen to him. Now the next question is why would they want something to happen to him? I wonder what he knew?

I have to admit I’m fed up with our newspaper. It seems as if they’d be happy to see Carlton get off on a technicality. As much as I disagree with Teresa, I do agree that Michael Mack’s presence on the GJ Commission and the GJ itself is a little too cozy. Also the SN is more of a witless comedy than a newspaper.
OBTW Mr. Cook knows damn well that only 23 jurors were polled for the Vines indictment. He was there in court the day Judge Hill swore the jury in. He’s playing with peanuts. These technicalities have nothing to do with justice.
Neither is justice served by the mentality generally exhibited by Teresa’s little internet lynch mob.

I don’t know you or Teresa or anyone else who posts to this site. I have no motivation other than the truth. I don’t hate Bobby Lee. I only ever knew him through Branch’s eyes and as I said before, Branch loved that man. I cannot say that I don’t despise Kris, I do, but only because I know everything she did to Branch. Still, I don’t hate her. I feel some degree of sorrow for her. I am not sure what makes a person the way that she is. I suspect some type of sexual abuse but I don’t know that to be true. It is difficult for me to believe that anyone is just pure evil. I am not naiive enough, however, to believe that it never happens.
If Branch did, indeed, kill himself…..I will live with that if that is the truth. If there were a REAL investigation and that was the conclusion then so be it. (I will always find it very difficult to believe for many reasons.) BUT what if Branch did NOT kill himself??? Doesn’t he deserve, at the very least, an honest investigation? Either way, he is gone and nothing is going to bring him back. The very worst part is this, HE is the very person I would be calling and asking “what should I do” ……..I keep trying to hear his voice….his answers…..trying to fall back on those old standbys. “do what you know is right” “tell the truth” “go with your heart” He used to tell me he trusted my judgement above any other. I hope I am making him proud of me.
I read in one of the messages something about Branch and Kris and drugs. I never knew Branch to use drugs in the time I knew him. He was fond of wine and very fond of good cognac but never knew him to take an illegal drug. I have no idea about Kris. Branch often told me that she was too drunk to stand…..but never mentioned drugs.
For all that Branch was or was not, he had a good heart. He honestly was one of the best people I have known in my life. We all have our faults,I have more than most and Branch was not exempt from faults but I would pick him for my team any day , any game. In the end, his heart always won out and his heart was golden. For those of you who only know him by stories or innuendos…..I promise you, he may have been surrounded by others who were all of the things you say but he was a simple and good man. He was, as he loved to tell me, ” a good Big daddy” He loved to take care of his flock….and I am honored that he considered myself and my daughter among them.

I have a friend who was very close to Branch. He insists when I talk to him that Branch was a generous spirit, who loved life, and would never have killed himself. If anything, people I have talked to who knew him say he protected people, as you say, loved people in spite of their faults, and never judged others.
I cannot find a single person who can say anything bad about Branch’s motivations and intentions, except that I have been told he did use drugs, both he and Kris, quite a bit. Cocaine and Marijuana. But I was married to an attorney at one time, in Savannah Georgia, and while I did not use, it seemed like every other lawyer and his wife, back in the 80’s and 90’s did, including my ex husband.
And from what I have read about those who hung with the Clinton’s, it was part and parcel for that inner circle as well, (Not Hillary). The Cook clan and the Clinton’s were close.
But like I have said, Branch was greatly loved by his friends, neighbors and anyone who associated with him.
HOWEVER, you need to know that another individual, whose information I passed on to the feds, knew about some very Dark Secrets of Branch’s as well. If this proclivity was part of his life, and Kris if the activity you allude to resulting from sexual abuse, then the cartel could not afford for accusations to fly and secrets to get about illegal and lurid practices by the couple. All being lawyers, they could see where a divorce was headed, and so Branch had to be the sacrificial lamb.

As I said, during the time that I knew him I did not know him to use drugs but no doubt in the earlier years he did that and many other things.
Branch was not an angel but he did not deserve to die.
Kris should certainly NOT be a sitting judge.
I think you should be commended for all you do. I hope that it leads to the truth. I wish for Branch to have the peace in death he did not have in life.

Good news and BAD news. Good news is that what their (FBI & GBI) “chosen little” they choose to attack, they do very well. The “majority of reported crimes” they steer clear of, is BAD NEWS. (As in leave it to the local LE, LOL)
Banging on Law Enforcement (LE) doors seems only to alert the CARTEL that you know something and that is a dangerous position to be, if you get my drift. They are on the other side of the door, as here in Crooksville, the LE is a part of BLC enterprise, at least until the new sheriff (Everett) gets situated. Banging on the Feds doors is a hit or miss situation, mostly a miss! (From noted experiences) Of course they have their excuses and that is exactly what they are, EXCUSES!
My opinion is that they are limited in funds, personnel and time and when they can’t get to the little man (no publicity and without being PC (get my drift again) not offending their superiors or friends). This is reality! This is “justice too funny.”
More opinion, but if they would engage and stop the small stuff, it would never reach the CARTEL size we now experience. AS IN HOW much corruption does it take for one to be corrupt?
I was involved in several situations with Branch and he was as dirty (corrupt) as they came. Sadly, this is what he was being paid to do. Lawyers don’t seek the truth when their client is guilty, they seek to WIN, regardless of right or wrong, ANY WAY POSSIBLE, like BLC technicalities again trust me.
Personally, I would welcome vigilantes, same as some others who have called for them!

I would agree with you but there is one problem, there is not any justice in this area. I was at a local place in Chattanooga today where attorneys gather and it was funny how one person was making fun of the LMJC. One even said he would have a better chance of winning a case representing a KKK member in Kenya because if you are not in this circle of corruption you will not win anything. They were also having some fun at the fact that cunningham was voted the best law firm in Walker County and how if he did not have woods as a close friend and neighbor he probably could not win anything.
Today the SN website is sticking more to what they can actually do. Those feel good stories about sports and local social events. They should just stick to that and leave real investigations to someone that knows how to research material. I was looking at the post from David Brown and I am thinking he smells a deal where the SN is concerned. Could it be that he wants to get back into “journalism”? LMAO. He is a real card, sometimes. No action on other reported crimes is not justified.

It is past time to say this. Ben Ballenger is the only attorney in the BLC Cartel area, includinf the GA BAR area, who has stood for the truth and honesty and it has almost cost him his life and has cost him an enormous amount of earnings (that$ money). Several have acknowledged this and he is a HERO and a champion for all honest (some ignorant LOL) people Chattooga and near-by areas under the influence of and victims of the Cartel, Dixie Mafia, BLC Enterprises, whatever you want to call it! Ben and TW have shouldered this very heavy load almost single handedly. I think I may have passed this on once before, or somebody did: All lawyers are REQUIRED to report other lawyers who are dishonest or corrupt in any actions or manner. HOWEVER, the next sentence states that there is NO PENALTY if they don’t. To me that sums up the Ga BAR Cartel, who share the BLC picture in their hollow halls.

Word around here is that following judge Kristina’s short grief period she welcomed a male house guest, a well known acquaintance of her’s. Word is that they are now officially engaged. A big diamond. He is what papa (BLC) should need, a heart surgeon. Of course all this is just a bunch of lies according to an unnamed Superior Court Judge. Maybe the Summerville News could poll the judges around here and find out which one is crusading against any investigations into Chattooga County Corruption Cartel. When I was a kid, the CCCC was building roads and things like that in the woods around here for FDR. These days the CCCC works for modern day democrats. And yes, we certainly do lust for and need REFORM.
